This document of general conditions of sale, or terms and conditions of sale, serves to regulate online purchases on the website www.eumakers.com  (ownedby the company "Rigenera di Sfrecola Cosimo Damiano") pursuant to the provisions of Part III , Title III, Chapter I, of the Consumer Code, Legislative Decree no. 206/2005, as amended by Legislative Decree n. 21/2014 and by Legislative Decree no. 70/2003 on e-commerce.

Shipping and Delivery

 

Handling Time

We ship worldwide.

We strive to get all orders received before 1PM (italian time zone) shipped out the same day. Orders not shipped same day wiill be shipped the following (business) day.
We ship weekdays, Monday-Friday. We do not ship on Saturday or Sunday or on any holidays.
Orders received after 1 PM Friday – Sunday will ship on the following Monday, assuming Monday is not a holiday.

We will contact you if for some reason there are any delays.

Please note that it is not possible to make a delivery to a PO box.

Customs and Duties

All orders shipping to a destination outside of the European Union are subject to the import duties, fees, and taxes of the destination country.
All applicable duties, taxes and custom requirements or other like taxes, fees, levies, costs or expenses associated with importing products you purchase from us are the sole responsability of the customer.

Customs authorities require that EUMAKERS states the value of your order directly on your package – the value is the retail cost.
EUMAKERS cannot mark any package(s) as a “Gift” in order to avoid customs and duties fees.

NOTES:

* If you pay by credit card or debit card, we will receive temporary authorization to charge your card once you have completed the payment process. We will charge you when we ship your order or when the temporary authorization ends, whichever come first.

** If a PayPal dispute occurs before shipment, the order will be held because PayPal will withhold payment under such circumstances. Please settle the dispute to proceed with the order.

*** The shipment will be made only after the recognition of the bank transfer. To speed up shipping procedures please send email copy of the receipt of the bank transfer.

Please note that EUMAKERS is not responsible for any customs fees (see “Customs and Duties”).


Return Policy

We want all our customers to receive high quality products.

 

Annulment – Right of Withdrawal

The right of withdrawal is governed by the current legislation referred to in Articles 52 et seq. of the Consumer Code, as amended by LEGISLATIVE DECREE 21 February 2014, no. 21.
Customers can return the product even if they have changed their mind and are no longer interested in the same without bearing costs other than those provided in Article 56, para 2, Article 57 of said Decree.

Please note: The right of withdrawal under Articles 52 et seq. of the Consumer Code is RESERVED EXCLUSIVELY for Consumers, who are defined by Article 3 of the Consumer Code as the natural person who acts for purposes unrelated to any business, commercial, craft or professional activity that may be carried out (2). Therefore, those who purchase with a VAT number and, thus, as a company and/or professional, cannot exercise the right of withdrawal.

 

Warranties and Non-Conformity of Products

Products offered on the site comply with Italian legislation and EU legislation in force in Italy.
All products sold on the Website are covered by the Legal Compliance Guarantee according to the Articles128-135 of the Italian Consumer Code ("Legal Warranty"). The Legal Warranty is for consumers only.
The Legal Warranty of Conformity refers to all consumer goods purchased by you and covers defects of conformity of the goods for a maximum period of 24 months for purchases made by private individuals, who have purchased the goods for uses unrelated to a commercial, entrepreneurial or professional activity, pursuant to Article 128 and following of the Consumer Code (Legislative Decree no. 206/2005)

Products Restitution

The customer, after communicating his reasons (via email, phone or registered mail), has 14 days to return products to EUMAKERS.

 

Exchange

EUMAKERS is happy to exchange your purchase -in its original unbroken packaging- for another one with same value.

 

Costs of Products Restitution/Exchange

In case of annulment, the customer has to pay shipping costs to return products to EUMAKERS.
All products must be returned in their original packaging with all enclosed documentation.
The packaging cannot be broken or in any other way damaged, neither can the product. otherwise it will not be possible to obtain a refund.
The goods are your responsibility until they reach our warehouse.
Please ensure you pack the return safely to prevent any damage to the products or boxes.
In case of exchange, the customer has to pay shipping costs for receiving the new item/s.

 

How to Return a Product

Please note that when you return a product it is very important to state the order number as well as your name, address and phone number. Without these details we will not be able to process your refund. Furthermore, a detailed description of the problem is necessary – if you have a claim. Please enclose the return form with the returned products:

Once we have received the returned products, we will inspect them and process the refund within 14 days.

Once we have received the returned products, we will inspect them and process the refund within 14 days.
The refund will be made through the same payment system the product has been bought through.
Shipping costs will not be refunded.
Purchases made through Paypal will be refunded directly to Paypal account within 14 days by the annulment.
Purchases made through Bank Transfer will be refunded directly to Bank Account within 14 days by the annulment.
Purchases made through Credit/Debit Card will be refunded directly to Credit/Debit Card within 14 days by the annulment.


Settlement of disputes

All disputes arising from this contract will be referred to the Chamber of Commerce of Bari and resolved in accordance with the Conciliation Rules adopted by it.
If either Party intends to refer the matter to the ordinary judicial authority, the jurisdiction is the place of residence or domicile of choice the consumer, mandatory under Article 33, paragraph 2, point u) of the Legislative Decree No. 206/2005.

Pursuant to the provisions of Article 14 of EU Regulation 524/2013/EU, Consumers residing in Europe are hereby informed that the European Commission has set up an online platform that provides an alternative dispute resolution tool. This service may be used by European consumers to resolve any dispute relating to, and/or arising from, contracts of sale for goods and services stipulated on-line by means of a non-judicial process.
